Abstract:
The aim of this article is to highlight the European experience of institutionalizing the data protection, analyze the specifics of the application of certain provisions of the General Data Protection Regulation, and on this basis, characterize the efficiency of the European legal framework. The results of the research showed that creating conditions for the efficient enforcement of data protection legislation depends on many factors of a geo-economic, geopolitical, and institutional nature. Currently, enforcement is limitedly efficient due to the entrenchment of globally monopolistic information asymmetry – the informational dominance of corporations over their users as a result of advantages gained from possessing advanced technologies for collecting and systematizing information for the economic and socio-humanitarian purposes of corporations. The conditions of global monopolistic information asymmetry will create additional pressure on the activities of ordinary subjects in the information space due to the increasing uncertainty. The article emphasizes the necessity of implementing European legislation within the Ukrainian legal framework and forming appropriate supervisory structures. Also, it is shown that data protection will take on an increasingly conflicted nature, driven by the peculiarities of ownership forms in the digital economy. Against this backdrop, the legal will and determination of the state to act in the context of protecting the rights of the most vulnerable users in the information space is essential.
